Brian D. Shank is a construction litigation and transactional attorney who is Board Certified in Construction Law by the Florida Bar.  His practice comprises the representation of design professionals, construction managers, contractors, material suppliers, and modular space providers in federal and state court, as well as in appeals and alternative dispute resolution proceedings.

Brian has represented design professionals in errors and omissions claims involving a broad spectrum of disciplines from roadway, stormwater, wastewater, structural, environmental, and geotechnical engineering to architecture and landscape architecture.  He has also handled the defense of personal injury and wrongful death claims involving roadway design and maintenance of traffic issues.   Brian was intensively involved in defending a Fortune Top 100 engineering firm from design defect claims involving the design and construction of the airside infrastructure of a major Florida airport.

For over 17 years, Brian’s practice has had a special focus on the representation of national and multi-national mobile space providers in both litigation and commercial transactions.  In that time, Brian has gained a uniquely deep knowledge of the modular industry, its products, operations, and resultant legal challenges.  He is privileged to regularly support in-house legal departments and local branch offices throughout the United States and Canada in contract review and negotiation, bid preparation, asset recovery, collections, construction defect litigation, and risk avoidance.
